Probate is a court process that is often needed when someone dies in order for the deceased assets to be properly distributed.  This occurs when the heir(s) of the estate may need to manage and settle the assets but currently lack the legal instruments to do so.

It’s a common practice for Attorneys to simply open probate, hire a third party to sell off all the deceased real property, and then payoff the deceased’s creditors in full. Our office does not take the simple approach.
